2. Scope

These General Terms and Conditions apply to all legal transactions between the Contractor and a Consumer (according to § 13 of the German Civil Code (BGB), a “natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity”).

3. Conclusion of contract and storage of the contract text

The provisions of these GTC apply to orders which consumers conclude via the website www.tikunacoffee.com of the online store Tikunacoffee. The contract is concluded with the Contractor (see § 1). The presentation and description of the goods on the website of the model store www.tikunacoffee.com does not constitute a contract offer. By ordering a product by clicking on the button “order with costs” at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is not concluded until the Contractor sends an order confirmation by e-mail. The text of the contract is stored when orders are placed. Consumers receive an e-mail with the order data and the applicable GTC. After conclusion of the contract, the order data can no longer be viewed online.

4. Payment

The statutory sales tax and other price components are included in the prices shown. Shipping costs or delivery charges are not included in the displayed price and may be additional. The following payment options are available to consumers:

 (1)When paying by credit card, the purchase price will be reserved on your credit card at the time of the order (authorization). The actual charge to your credit card account occurs at the time we ship the goods to you.

(2) When paying with PayPal, you will be redirected to the website of the online provider PayPal during the ordering process. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. You will receive further instructions during the order process. The payment transaction is automatically carried out by PayPal immediately afterwards.

(3) In the case of payment by direct debit, you shall bear any costs incurred as a result of a chargeback of a payment transaction due to a lack of funds in the account or due to incorrect bank details provided by you.

In the event of nonpayment by the Consumer side, and subject to legal restrictions, the Contractor is entitled to charge any predetermined reasonable costs incurred to the Consumer.

5. Delivery, delivery restrictions

Delivery is made – unless the description of a selected product explicitly states otherwise – within 7 working days. This period begins in the case of payment via bank transfer or Paypal on the day after the issuance of the payment order.

The delivery address is provided by the Consumer at the time the contract is made via the web shop. This Address will be use by the Contractor to fulfil the contract

6. Transfer of risk

The risk of accidental deterioration or accidental loss of the goods shall remain with the Contractor until the goods are handed over and shall pass to the consumer upon handover.

7. Retention of title

The Contractor retains ownership of the goods until the purchase price has been received in full.

8. Warranty

The statutory warranty regulations apply
